Welcome to LUMIERE. By accessing or using our service, you agree to these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By creating an account or using LUMIERE ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

2. Service Description

LUMIERE is a subtitle translation service that allows users to:

• Upload subtitle files (SRT, VTT formats)
• Translate subtitles using AI-powered translation (Pro feature)
• Edit and review translated subtitles with quality control tools
• Export translated subtitle files

Free features include file parsing, manual editing, quality control dashboard, and export. AI-powered translation requires an active Pro subscription.

3. Accounts

• You must provide a valid email address to create an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 18 years old to use the Service.
• One account per person. Sharing account credentials is not permitted.
• We reserve the right to suspend or terminate accounts that violate these terms.

4. Subscription & Billing

• The Pro subscription is billed at $9.99 per month.
• Subscriptions are recurring and will auto-renew each month until cancelled.
• Payment is processed securely through Stripe. We do not store your payment information.
• By subscribing, you authorize us to charge your payment method on a recurring monthly basis.
• Prices may change with 30 days' notice. Existing subscribers will be notified before any price change takes effect on their next billing cycle.

5. Cancellation & Refunds

• You may cancel your subscription at any time through the Account page or Stripe Customer Portal.
• After cancellation, your Pro access remains active until the end of the current billing period.
• No partial refunds are provided for unused time within a billing cycle.
• If your payment fails, Pro access will be suspended until payment is successfully collected.

6. Intellectual Property

• Your content: You retain full ownership of your subtitle files and translations. LUMIERE does not claim any rights over content you upload, translate, or download.
• Our service: The LUMIERE application, its design, code, and branding are the property of WattWorks Design. You may not copy, modify, or redistribute any part of the Service.
• AI-generated translations: Translations produced by AI services (Claude, OpenAI) are provided to you for your use. You are responsible for reviewing translations for accuracy before use in any production context.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to circumvent subscription restrictions or access controls.
• Abuse the translation API with automated scripts or excessive requests beyond normal use.
• Upload files containing malicious code.
• Resell or redistribute the Service or access to it.
• Interfere with the operation of the Service or its infrastructure.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Specifically:

• We do not guarantee that AI translations will be 100% accurate, complete, or suitable for any particular purpose.
• We do not guarantee uninterrupted or error-free service availability.
• Translation quality depends on the AI models provided by third-party services (Anthropic, OpenAI) and may vary.

You are responsible for reviewing and verifying all translations before use.

9. Limitation of Liability

To the maximum extent permitted by law, WattWorks Design and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, but is not limited to, damages from:

• Inaccurate translations
• Service interruptions or data loss
• Unauthorized access to your account
• Actions of third-party service providers

Our total liability for any claim related to the Service shall not exceed the amount you have paid us in the 3 months preceding the claim.

10. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via the email address associated with your account. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which WattWorks Design operates, without regard to conflict of law provisions.
